This volume explores the relationship between rationality and happiness from ancient Greek philosophy to early Latin medieval philosophy. What connection is there between human rationality and happiness? This issue was uppermost in the minds of the Ancient Greek philosophers and continued to be of importance during the entire early medieval period. Starting with theSocrates of Plato's early dialogues, who is regarded as having initiated the eudaimonistic ethical tradition, the present volume looks at Plato, Aristotle, the Skeptics, Seneca [Stoicism], Epicurus, Plotinus (...) [neo-Platonism], Augustine, Boethius, Anselm, and ends with Abelard, the final major figure in early medieval philosophy. Special efforts are made to reveal and trace the continuity and development of the views on rationality and happiness among these major thinkers within this period. The book's approach is historical, but the topics it treats are relevant to many discussions pursued in contemporary philosophical circles. Specifically, the book aims to make two major contributions to the ongoing development of virtue ethics. First, contemporary virtue ethics often draws distinctions between ancient Greek ethics and modern moral philosophy [mainly utilitarianism and Kantianism], and seeks to model ethics on ancient ethics. In doing so, however, contemporary virtue ethics often ignores the transition from Greek ethics to the early Latin medieval tradition. Second, contemporary virtue-based ethics, in its efforts to seek insights from ancient ethics, centers on virtue. In contrast, in ancient and medieval ethics, virtue is pursued for the sake of happiness [eudaimonia], and virtue is conceived as excellence of rationality. Hence, the relationship between rationality and happiness provides the framework for ethical inquiry within which the discussion of virtue takes place. O objetivo deste artigo é analisar o conceito de vivência (Erlebnis) na filosofia de Nietzsche, desde o seu primeiro emprego em língua alemã, seu significado e a recepção que Nietzsche faz da palavra no interior da sua filosofia. O conceito de Erlebnis, particularmente caro à filosofia de Nietzsche, mas também à fenomenologia, possui originariamente uma tríplice significação: a) a imediatez (Unmittelbarkeit) entre homem e mundo; b) a significabilidade (Bedeutsamkeit) para o caráter global da existência; e c) a incomensurabilidade (Inkommensurabilität) do (...) conteúdo da própria vivência, conferindo a ela também uma dimensão estética. A tríplice significação de Erlebnis implica na sua estreita associação a pathos. This paper aims to analyze the concept of experience (Erlebnis) in the Nietzsche's philosophy, since its first use into the German language, its meaning and reception of Nietzsche inside his philosophy. The concept of Erlebnis, especially dear to the philosophy of Nietzsche, but also to phenomenology, originally has a triple meaning: a) the immediacy (Unmittelbarkeit) between man and world, b) meaningfulness (Bedeutsamkeit) to the global nature of existence and c) incommensurability (Inkommensurabilität) of the experience's content itself, giving it also an aesthetic dimension. Entre los medios elegidos para el logro de los objetivos transhumanistas (TH) se encuentra el recurso a biotecnologías para incidir en la dotación genética de la descendencia. Ahora bien, el temor a una utilización desmesurada de las biotecnologías no puede significar una negación de los indudables avances para el bien de la vida humana que ellas han traído. Así, desde una perspectiva jurídica, es decisiva la cuestión de determinar los alcances de la libertad procreativa, es decir, cuáles son las opciones (...) legítimas que pueden adoptarse en relación con la transmisión de la vida humana. Esta comunicación se propone analizar este interrogante y enunciar los desafíos jurídicos implicados en esta cuestión. En tal sentido, mientras algunos sostienen una libertad procreativa absoluta y sin límites, otras posturas tienden a anular la libertad procreativa y a obligar a los padres a buscar “el mejor hijo posible” (beneficencia procreativa). Entre esas dos visiones extremas, esta comunicación propone una libertad procreativa respetuosa de la originalidad de la transmisión de la vida y enraizada en una concepción ontológica de la dignidad. Por otra parte, para que esa libertad procreativa realice los bienes propiamente humanos, se enuncian seis tópicos que el derecho debe afrontar para responder a los desafíos del TH en esta dimensión vinculada con la procreación: a) el comienzo de la existencia de la persona; b) la inviolabilidad de la vida humana; c) los límites jurídicos que deben ponerse a las técnicas de procreación artificial y sus finalidades de uso; d) si es admisible o no el uso de gametos de terceros en esas técnicas; e) el problema del diagnóstico preimplantatorio; f) los alcances de la edición genética humana aplicada a la línea germinal y la distinción entre terapia y mejora (enhancement). This paper deals with Fichte’s The Characteristics of the Present Age, and in particular with his discussion of the “empty form of knowledge” he claims stands at the centre of the third – i.e. the present – age. Fichte speaks of a fundamental principle that forms the ‘common denominator’ between the third and fourth main epochs. This fundamental principle – the “maxim of comprehensibility” – makes knowledge and comprehension the measure of all that “counts as being valid and as really (...) existing”. But the question arises: How can one and the same principle act as the “unifying concept” for two different “main epochs of human life”? Does this not go directly against Fichte’s claim that two main epochs differ from each other in every respect, precisely because they arise from two entirely different “unifying principles”, and because everything in them must reflect the difference between their “unifying principles”? Fichte’s answer to this question is as follows: a) the fundamental maxim in question allows for two diametrically opposed interpretations, so that each of them provides the principle or the “unifying concept” from which the third and fourth main epochs arise, and b) the third main epoch only gives rise to the empty form of science, as opposed to “truly real science”: it stands for a careless and easy-going, shallow, conventional, trivializing and incorrect conception of the “fundamental maxim of comprehensibility” – so that it misses what is essential, does not do justice to the fundamental maxim, overlooks its implications, and indeed goes against its innermost meaning. Special attention is paid to the question of whether and how some major features of Fichte’s “empty form of knowledge” result from a misguided and superficial understanding of Kant’s “maxims of the self-preservation of reason” and can be reconstructed from this vantage point. In this paper we propose that the concept of mediatization should be used not only in the narrow sense to analyze the impact of media on the operational modes of the political system, but also in more general terms to capture the transformation of the public sphere and the changing conditions for the generation of political legitimacy. More specifically and with regard to the role of political communication on the internet, we focus on the transformative potential of online media in (...) terms of a) publicity: the capacity of the online media to focus public attention on the political process of the EU; b) participation: the capacity of the online media to include plural voices and activate the audience; and c) public opinion formation: the capacity of the online media to enable informed opinions. We test our mediatization model on the online debates that took place during the 2009 EU elections in 12 member-states and at the trans-European level. The findings confirm the mediatizing impact of online political communication on the generation of the political legitimacy of the EU. Online media constitute a virtually shared forum for political communication that political actors and users increasingly occupy developing homogenous patterns of evaluating European integration. Furthermore, the stronghold of offline media in the EU e-sphere and the tendency to discuss the EP elections within the frame of domestic politics reaffirm the key role of national political and media cultures. Through a convenience sample of 260 employees, the study shows how employees’ perceptions about corporate citizenship (CC) predict their affective commitment. The study was carried out in Portugal, a high in-group and low societal collectivistic culture. Maignan et al.’s (1999, Journal of the Academy of Marketing Science27(4), 455–469) construct, including economic, legal, ethical, and discretionary responsibilities was used. The main findings are: (a) contrary to what has been presumed in the literature, the discretionary dimension includes two factors: CC toward employees (...) and toward community; (b) perceptions of CC explain 35% of unique variance of affective commitment; (c) the best predictors are perceptions of economic and legal CC and, mainly, perceptions of discretionary CC toward employees; (d) the perceptions of discretionary CC toward employees are significantly better predictors of affective commitment than are perceptions of economic, ethical, and discretionary CC toward the community; (e) perceived inconsistency of the several CC dimensions is detrimental to employees’ affective commitment. The study questions the four-dimensional model of the CC construct as operationalized by Maignan et al., suggests that culture should be included as a moderating variable in future research, and stresses that affective commitment may decrease when employees perceive that their organizations act upon the several areas of CC inconsistently. Background Neuroscientific approaches have historically triggered changes in the conception of creativity and artistic experience, which can be revealed by noting the intersection of these fields of study in terms of variables such as global trends, methodologies, objects of study, or application of new technologies; however, these neuroscientific approaches are still often considered as disciplines detached from the arts and humanities. In this light, the question arises as to what evidence the history of neurotechnologies provides at the intersection of creativity (...) and aesthetic experience. Methods We conducted a century-long bibliometric analysis of key parameters in multidisciplinary studies published in the Scopus database. Screening techniques based on the PRISMA method and advanced data analysis techniques were applied to 3612 documents metadata from the years 1922 to 2022. We made graphical representations of the results applying algorithmic and clusterization processes to keywords and authors relationships. Results From the analyses, we found a) a shift from a personality-focus quantitative analysis to a field-focus qualitative approach, considering topics such as art, perception, aesthetics and beauty; b) The locus of interest in fMRI-supported neuroanatomy has been shifting toward EEG technologies and models based on machine learning and deep learning in recent years; c) four main clusters were identified in the study approaches: humanistic, creative, neuroaesthetic and medical; d) the neuroaesthetics cluster is the most central and relevant, mediating between creativity and neuroscience; e) neuroaesthetics and neuroethics are two of the neologism that better characterizes the challenges that this convergence of studies will have in the next years. Conclusions Through a longitudinal analysis, we evidenced the great influence that neuroscience is having on the thematic direction of the arts and humanities. The perspective presented shows how this field is being consolidated and helps to define it as a new opportunity of great potential for future researchers. (shrink)

A theory can be an explanation of a piece of the world. A theory of law is intended to be an explanation of that phenomenon of social communication which we call Law. But, Raffaele De Giorgi, perhaps the person responsible for the introduction of luhmannian theory in Argentina, (jointly with Torres Nafarrate in Mexico in translating Luhmann’s work to Spanish), asked: What is a theory of society? What is the “Law of society”? And answered: Can we discuss this?, hands managed (...) by hands, nothing different from a prostheses. According to De Giorgi we are sure that the themes that we use as objects or objects that we use as themes, are our construction, we think that we turn around ourselves, while we continue rotating around the vacuum. It is a paradox, or another paradox: ¿Is it possible to get out or get rid of these paradoxes? Logic does not help us. Logic, according to Luhmann, can only see to the fact that some expressions, with unavailable truths, are in contradiction with other expressions, the problem cannot be resolved us- ing logical operations. With the help of Gegenparadoxierungen (against-par- adox), systemic therapy is the alternative where the problem can be toler- ated. And, according to Luhmann, the placement of the paradox should be conducted in a more or less skilled, successful, or useful way to break the logjam.A creative use of paradoxes, especially legal ones, allows us to observe how Luhmann’s theory has impacted existing theories in ArgentinaThemes such as the paradoxality of law, or its being without foundation (and without beginning, the vacuity of their principles and the opacity of its distinctions and operations), filtered theories (like Carlos Cárcova or Ernesto Grün) and jurisprudential practices have started shifting things to what Bielefeld Professor has called “old European”Resumen:Una teoría puede ser una explicación de un sector del mundo. Usando operaciones lógicas, el problema no puede ser resuelto. Como terapia sistémica la única que podemos ver, con el auxilio de la Gegenparadoxierungen (“contra-paradoja”), es un lugar menos doloroso en el que puede tolerarse el problema. Y recordó que, en cierto sentido, la colocación de la paradoja se realizará con más o menos éxito, esto es: de manera útil para desbloquear la situación.Y es el uso creativo de paradojas, especialmente uno que se hizo por el Derecho, el que nos permite observar cómo su teoría (la de Luhmann) se ha comenzado a reciclar en las teorías existentes en Argentina. Temas como el problema de la paradojalidad del Derecho, de su ser sin fundamentos y sin comienzo, de la vacuidad de sus principios y la opacidad de sus operaciones y distinciones, se filtran teorías (como las de Carlos Cárcova o Ernesto Grün) y prácticas de la jurisprudencia y puede verse que ha comenzado a remover ese tipo de pensamiento que el profesor de Bielefeld había llamado “vétero europeo”. This paper reports the framework, method and main findings of an analysis of cultural milieus in 4 European countries. The analysis is based on a questionnaire applied to a sample built through a two-step procedure of post-hoc random selection from a broader dataset based on an online survey. Responses to the questionnaire were subjected to multidimensional analysis-a combination of Multiple Correspondence Analysis and Cluster Analysis. We identified 5 symbolic universes, that correspond to basic, embodied, affect-laden, generalized worldviews. People in this (...) study see the world as either a) an ordered universe;b) a matter of interpersonal bond;c) a caring society;d) consisting of a niche of belongingness;e) a hostile place. These symbolic universes were also interpreted as semiotic capital: they reflect the capacity of a place to foster social and civic development. Moreover, the distribution of the symbolic universes, and therefore social and civic engagement, is demonstrated to be variable across the 4 countries in the analysis. Finally, we develop a retrospective reconstruction of the distribution of symbolic universes as well as the interplay between their current state and past, present and future socio-institutional scenarios. Osteopathy is a person-centred healthcare discipline that emphasizes the body’s structure-function interrelationship—and its self-regulatory mechanisms—to inform a whole-person approach to health and wellbeing. This paper aims to provide a theoretical framework for developing an integrative hypothesis in osteopathy, which is based on the enactivist and active inference accounts. We propose that osteopathic care can be reconceptualised under active inference as a unifying framework. Active inference suggests that action-perception cycles operate to minimize uncertainty and optimize an individual’s internal model of the (...) lived world and, crucially, the consequences of their behaviour. We argue that active inference offers an integrative framework for osteopathy, which can evince the mechanisms underlying dyadic and triadic exchanges and osteopathic care outcomes. We propose that this theoretical framework can underpin osteopathic care across the lifespan, from preterm infants to the elderly and those with persistent pain and other physical symptoms. In situations of chronicity, as an ecological niche, the patient-practitioner dyad provides the osteopath and the patient with a set of affordances, i.e., possibilities for action provided by the environment, that through shared intentionally, can promote adaptations and restoration of productive agency. Through a dyadic therapeutic relationship, as they engage with their ecological niche’s affordances—a structured set of affordances shared by agents—osteopath and patient actively construct a shared sense-making narrative and realise a shared generative model of their relation to the niche. In general, touch plays a critical role in developing a robust therapeutic alliance, mental state alignment, and biobehavioural synchrony between patient and practitioner. However, its role is particularly crucial in the fields of neonatology and paediatrics, where it becomes central in regulating allostasis and restoring homeostasis. We argue that from an active inference standpoint, the dyadic shared ecological niche underwrites a robust therapeutic alliance, which is crucial to the effectiveness of osteopathic care. Considerations and implications of this model—to clinical practice and research, both within- and outside osteopathy—are critically discussed. (shrink)

Gracias a la inclusión del testimonio heraclíteo, resulta posible rastrear la presunta consolidación de la tesis sobre los nombres primarios y los secundarios como el eje de la separación entre dos planos de realidad (uno estable y uno móvil) (...) y de la teoría de las Ideas -es decir, como la base de la epistemología platónica presente en los diálogos de madurez-. The article seeks to trace the image Plato has of Heraclitus and connect it with the argumentative structure of the Cratylus in order to understand the textual needs that give rise to the doctrine of perpetual flux, that is, the discussion regarding the correctness (ὀρθότης) of names. The inclusion of Heraclitus's testimony makes it possible to trace the alleged consolidation of the thesis regarding primary and secondary names as the axis of separation between two levels of reality (one stable, the other, changing) and the theory of Ideas -that is, as the basis of Plato's epistemology as set forth in the late dialogues-. Este artículo cuestiona filosóficamente, a partir de las tesis de Günther Anders, el uso masivo de las redes sociales y la forma en que configuran la subjetividad y la intersubjetividad, particularmente en cuanto a los efectos cognitivos sobre la verdad, las creencias y la objetividad. El uso intensivo y compulsivo de las redes sociales ha permitido una comunicación casi instantánea y una sociedad presta a la observación y vigilancia de todos los aspectos de la vida cotidiana y de la política; (...) pero, al mismo tiempo, ha impulsado una sociedad de la intrusión, el voyerismo, el juicio moral lapidario y el linchamiento público de personajes famosos o de cualquier persona acosada por sus conductas, aunque estas pudieran no ser verdaderas. Manuel Castells observaba en La era de la información (2000), que en nuestra época se ha trastocado el tiempo, se han fundido y confundido lo real y lo virtual, lo público y lo privado, generando nuevos problemas éticos, jurídicos y políticos. Tenemos ahora una subjetividad hipersensibilizada, saturada de información, de verdades y falsedades indistinguibles que complican la comunicación y el sentido compartido de la realidad, así como las responsabilidades y las acciones sociales efectivas para contribuir al bien público. This paper offers theoretical explanations for why “guided touch” or manual touch with verbal communication can be an effective way of treating the body and the mind. The active inference theory suggests that chronic pain and emotional disorders can be attributed to distorted and exaggerated patterns of interoceptive and proprioceptive inference. We propose that the nature of active inference is abductive. As such, to rectify aberrant active inference processes, we should change the “Rule” of abduction, or the “prior beliefs” entailed (...) by a patient’s generative model. This means pre-existing generative models should be replaced with new models. To facilitate such replacement—or updating—the present treatment proposes that we should weaken prior beliefs, especially the one at the top level of hierarchical generative models, thereby altering the sense of agency, and redeploying attention. Then, a new prior belief can be installed through inner communication along with manual touch. The present paper proposes several hypotheses for possible experimental studies. If touch with verbal guidance is proven to be effective, this would demonstrate the relevance of active inference and the implicit prediction model at a behavioral level. Furthermore, it would open new possibilities of employing inner communication interventions, including self-talk training, for a wide range of psychological and physical therapies. (shrink)

The right not to know is underappreciated in policy-making. Despite its articulation in medical law and ethics, policy-makers too easily let other concerns override the right not to know. This observation is triggered by a recent decision of the Dutch government on embryo selection for Huntington’s disease. This is a monogenetic debilitating disease without cure, leading to death in early middle age, and thus is a likely candidate for preimplantation genetic diagnosis. People possibly affected with the Huntington gene do not (...) always want to know their genetic status themselves, which is very burdensome knowledge. For prospective parents, this creates a difficulty in having unaffected children through embryo selection without knowing their own genetic status. A solution is provided by the exclusion test: it allows embryo selection while honouring the parents’ right not to know. The Dutch government however disallowed the exclusion test and chose to allow PGD on Huntington only for parents who test themselves first. To avoid “unnecessary” in-vitro fertilisation procedures for unaffected parents, prospective parents are “forced to know” before they can conceive through embryo selection. This article analyses the scope of the right not to know in the context of embryo selection against Huntington’s disease. It concludes that the right not to know implies that PGD against Huntington should be allowed by means of the exclusion test. (shrink)

The sudden emergence of the COVID-19 pandemic brought global disruption to every aspect of society including healthcare, supply chain, the economy, and social interaction. Among the many emergent considerations were the safety and public health of the public, patients, essential workers, and healthcare professionals. In certain locations, clinical research was halted—or terminated—in deference to the immediate needs of patient care, and clinical trials focusing on the treatment and prevention of coronavirus infection were prioritized over studies focusing on other diseases. Difficult (...) decisions were made rapidly; flexibility and reconsideration were necessary not only because the intensity and severity of infection varied over time and by locale but also because knowledge of the disease and understanding of its treatment grew. In 1968, Aimé Césaire travelled to Cuba to participate in the Havana Cultural Congress, a mass international meeting where delegates discussed the place of culture in the struggle against imperialism, neo-colonialism, and underdevelopment. Among the likes of C.L.R. James, Nicolás Guillén, René Depestre, Michel Leiris, and Daniel Guérin, it was in Havana that the Martinican politician undertook the until-now untranslated interview with Sonia Aratán for the Casa de las Américas revue and delivered his Cultural Congress conference paper – previously believed (...) by Césaire scholars to be lost. Both texts shed light on Césaire’s little-known views on Fidel Castro, the Cuban Revolution and Marxism in the context of late-1960s tricontinentalism. By reconstructing Césaire’s exchanges with Cuban writers before and during the Congress, we propose a consideration of the role of Cuba in Césaire’s political thought as a tragic possibility, combining the catastrophe of Caribbean history with the uncertain potential of new social forms. ResumenEl estudio de las prácticas materiales de una sociedad requiere considerar los tipos de enmarcamiento epistemológico en que se desarrollan y sus efectos sobre éstas. Los modos de categorizar y distinguir y los modos organizar y agrupar son parte del enmarcamiento de las prácticas que este texto aborda. En particular, explora conceptualmente los modos de organización de conjuntos basados en la distinción agregativa entre lo singular y lo plural y los modos de organización enfocados en el efecto compositivo de la (...) diferencia entre molécula y masa. Ortho Pharmacetrtical Corp. ), the Supreme Court of Illinois held that, although a federal regulation requires pharmaceutical manufacturers to provide direct warnings to consumers about the dangers associated with oral contraceptives, this regulation does not constitute an exception to the learned intermediary doctrine and the manufacture will not be held strictly liable. The court declined to recognize an exception for manufacturers of contraceptives due to important policy considerations and the legislative intent underlying the learned intermediary doctrine. The (...) doctrine is based on the assumption that prescribing physicians, not pharmaceutical manufacturers, are in the best position to provide direct warnings to patients concerning the dangers associated with prescription drugs. The decision may affect patients whose medical care providers are unable to account for drug propensities or patient susceptibilities. Additionally, patients with forgetful or inarticulate health care providers are at risk. (shrink)
